She died in vain! Court sentences man who killed his girlfriend to 5 years imprisonment

A father-of-two who killed his partner during a row on a date night has been jailed for five years.

Lloyd Birkby, 27, of Langdale Street, Elland, admitted the manslaughter of 26-year-old Levi Ogden, who died during a night out in Halifax town centre.

Levi, a mum-of-two from the market town of Elland in Calderdale, West Yorkshire, was found unconscious and seriously injured in Silver Street in Halifax at around 2.16am on November 3 last year.

Birkby also pleaded guilty to common assault in relation to one of Ms Ogden's friends that night and denied a further common assault allegation, Yorkshire Live reports.

The pleas were accepted at a previous hearing and he was sentenced this week..

The court was told how CCTV captured the moment that Ms Ogden was struck in the neck by a mobile phone by Birkby.

“He was a few short ft away. He picked up the phone and threw it at the deceased which struck her in the neck.

“When confronted by her friend Courtney Bland he shoved her to the ground and walked away across the road.”

The court heard the Levi was ‘left dying in the street by the defendant’.

Mr Enoch said: “She was helped in the street by street angels, paramedics and then by the police.

“Mr Birkby was aggressive in his manner at the time and was clearly under the influence of drink.”

Ms Ogden, a mum to two children, was rushed to hospital but later died.

Medical evidence found that she when she was struck in the neck it caused a tear that led to a haemorrhage.

She suffered bleeding into the brain which in turn lead to cardiac arrest.

Prosecution Dafydd Enoch QC said: "The defendant saw something on the floor, which was a dropped mobile phone.

The court heard that there was a history of domestic violence between the couple.

Dafydd Enoch QC told the court of previous incidents of domestic violence between the defendant and the deceased.

Defence Barrister Stephen Wood QC referred to a report which was done on the defendant.

It outlined that he has a mental age of just 11 years and 5 months and that his IQ is described as that of average.

Mr Wood said: “His previous convictions show that he has a history of pushing his victim, shoving his victim, and spitting at his victim and had admitted throwing objects at his victims.”

However, it was submitted by the defence that due to his mental capacity he should be placed in the lower culpability bracket.

Judge Geoffrey Mason QC sentenced Birkby to five years in prison for the manslaughter of Levi Odgen.

He was also given two months for the common assault of Courtney Bland. These will be served concurrently.
